how can i get my mothers money out of her bank account to pay for her funeral?
A "durable power of attorney" won’t help you if she’s already dead – that "power" died with her.
It would have to be a joint account with a living person who could make the withdrawal or it would have to be authorized by the court-appointed "personal representative of the estate."
As a general rule, however, the estate of a deceased person is NOT available to pay for a funeral, which is why there is funeral insurance. The children/spouse/heirs/friends have to pay for it "out of pocket", as the estate has no legal obligation to pay bills for new services that were not contracted by the decedent.
Your state law may vary. Talk to a local probate and estate administration attorney.
